1. Introduction

Welcome to the abbyrose Ambassador Program. By participating in this program, you ("Ambassador") agree to comply with these Terms & Conditions. Please read them carefully before submitting an application through our website via the Refersion platform.

2. Eligibility and Enrollment

• To join the abbyrose Ambassador Program, you must submit an application via the Refersion platform on our website.
• Selection criteria include social media engagement, creativity, and enthusiasm for the abbyrose brand. Our decision to accept or reject any application is at our sole discretion.
• Upon acceptance, Ambassadors will receive a welcome gift along with specific posting requirements.
• Only individuals residing in regions where the program is available are eligible.

3. Ambassador Responsibilities

• Ambassadors are responsible for promoting abbyrose products in a positive and ethical manner, adhering to the posting guidelines provided by abbyrose.
• Ambassadors will receive monthly free products and must comply with posting requirements to remain in the program.
• You must ensure that all promotional content complies with applicable laws and regulations, including FTC guidelines on affiliate disclosures. All sponsored posts must be clearly labeled as such (e.g., #ad, #sponsored).
• Unethical or deceptive marketing practices (such as false advertising, spamming, or manipulating referral tracking) are strictly prohibited and grounds for termination.

4. Personalized Referral Links

• Upon acceptance into the program, Ambassadors will receive a personalized referral link.
• Ambassadors will earn a 15% commission on all qualifying sales made through their referral link. The link will use a 60-day cookie for tracking, meaning sales made within 60 days of a user clicking your referral link will be eligible for commission.
• You are not allowed to alter or misuse the referral link in any way.

5. Commission and Payment Terms

• Commissions will be calculated as 15% of the net sales value (excluding taxes, shipping, and any discounts) generated through your referral link.
• Payments will be made on a monthly basis via your selected payment method through Refersion.
• There is no minimum payout threshold unless stated otherwise in Refersion’s platform guidelines.
• Commissions are not earned on returns or refunded sales. If an order that you have earned commission on is later refunded or cancelled, we reserve the right to deduct the corresponding commission from future payments.

6. Prohibited Conduct

• Ambassadors must refrain from any behavior, actions, or posting content that does not align with the values of abbyrose, including but not limited to hate speech, offensive content, or behavior that damages the reputation of the brand.
• Ambassadors are prohibited from promoting abbyrose products on websites, social media platforms, or other channels that contain illegal, offensive, or inappropriate content.

7. Intellectual Property

• As an Ambassador, you may use abbyrose’s branding assets (such as logos, product images, and trademarks) solely for the purpose of promoting our products. You may not alter these assets in any way or use them for any unauthorized purpose.
• abbyrose reserves all rights to its intellectual property, and any unauthorized use of this property will result in immediate termination of your Ambassador status.

8. Termination

• abbyrose reserves the right to terminate your participation in the Ambassador Program at any time, without prior notice, for violating these Terms & Conditions, including but not limited to:
  • Engaging in unethical or deceptive marketing practices.
  • Failing to comply with the provided posting requirements.
  • Promoting content or engaging in behavior that does not align with abbyrose’s values.
  • Any actions that may harm the reputation or operations of abbyrose.
• Upon termination, any unpaid commissions that are due and owing will be forfeited if termination is due to a breach of these Terms.

9. Liability Limitations

• abbyrose will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to this Agreement or the abbyrose Ambassador Program, including, but not limited to, loss of revenue, profits, data, or business opportunities.
• We do not guarantee the availability, security, or accuracy of your referral links or tracking technology. While we strive to maintain an uninterrupted system, technical issues or third-party actions may result in discrepancies or errors, for which abbyrose will not be held responsible.
• By participating in the Ambassador Program, you agree to indemnify and hold harmless abbyrose, its officers, directors, employees, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses arising from your participation in the program or violation of these Terms & Conditions.

10. Changes to Terms & Conditions

• abbyrose reserves the right to modify or update these Terms & Conditions at any time. You are responsible for regularly reviewing these Terms & Conditions to stay informed of any updates. Your continued participation in the program constitutes acceptance of any changes.

11. Governing Law

• These Terms & Conditions are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from or related to the abbyrose Ambassador Program will be subject to the exclusive jurisdiction of the courts located in Texas.
